Conviction in Armed Heist at Palisades Center Mall


Rockland County District Attorney Thomas P. Zugibe today announced that Christopher Fountain (07/07/82) of Mount Vernon, New York was convicted after a jury trial of:
•One count of Robbery in the First Degree, a class “B” Felony
•One count of Criminal Use of a Firearm in the First Degree, a class “B” Felony

On June 7, 2010, Fountain entered the Victoria’s Secret at the Palisades Center mall in West Nyack and ordered nine employees to the rear of the store at gunpoint. The defendant forced the workers to lay face-down on the floor and demanded that the manager open the store safe. Fountain fled the retailer with more than $16,000 in stolen cash.
The defendant was taken into custody on December 10, 2010 by police in the City of White Plains. He and three accomplices were charged in connection with the November 29th armed robbery of the Wal-Mart on Main Street, where a store manager was forced to open a safe, then was bound at the hands and feet. Fountain will be tried separately by prosecutors in Westchester County for the Wal-Mart heist and other alleged criminality.

Fountain’s trial began on May 16, 2011. Jurors deciding the case in the courtroom of Rockland County Court Judge William A. Kelly returned a verdict of guilty on all counts of the indictment.
A sentencing date is pending.

Fountain faces a maximum of twenty-five years in state prison.

The case was prosecuted by Senior Assistant District Attorney Richard Kennison Moran.
