Rockland County District Attorneys Office: Aggravated Driving While Intoxicated Indictments

Anthony Vitale was indicted on June 15, 2011 by a Rockland County Grand Jury for the crime of Aggravated Driving While Intoxicated with a Child.

District Attorney Thomas P. Zugibe stated that on or about November 29, 2010, at approximately 8:45 p.m., a member of the New York State Police observed defendant speeding and changing lanes unsafely while driving on Interstate 87 in the Town of Ramapo.  Upon approaching the vehicle, a Trooper observed two children (ages 4 and 6) in the back of the vehicle.  Upon speaking to the defendant, the Trooper observed defendant to be in an intoxicated condition as evinced by the odor of an alcoholic beverage, glassy eyes and impaired motor coordination.  The defendant failed three sobriety tests and his blood alcohol content revealed a .14%.
