Monsey Man Convicted in Scheme to Steal Thousands from Estranged Wife’s Medical Practice


YanKutsy.JPGRockland County District Attorney Thomas P. Zugibe today announced that Yan Kutsy (DOB 11/07/59) of Monsey, New York was convicted after a jury trial of:

• One count of Grand Larceny in the Second Degree, a class “C” Felony the sole count in the indictment.

In December, 2007, Kutsy opened an account at Washington Mutual Bank in the name of Rockland NY Medical Associates, P.C., a New City medical practice owned and operated by his estranged wife.

The defendant listed himself as the sole person with access to the account.
During the next 18 months, Kutsy systematically stole over $190,000 in checks made payable to Rockland NY Medical Associates by depositing the funds into the suspect account.

Doctor Yanina Kotlyar, the defendant’s estranged wife, discovered the crime.

On June 2, 2011, a trial commenced before the Honorable William A. Kelly. On June 16, 2011, shortly after closing arguments, the court returned a verdict of guilty on the sole count of the indictment.

Kutsy faces up to fifteen years in state prison when he is sentenced on August 24th.

The case was prosecuted by Senior Assistant District Attorney Richard Kennison Moran.
