Rockland County District Attorneys Office: Assault Plea


Noe Montez-Lopez of Spring Valley, New York, pled guilty on April 27, 2011 to Assault 2nd Degree and Criminal Mischief 4th Degree.

District Attorney, Thomas P. Zugibe stated that on or about November 7, 2010 at 63 East Eckerson Road in the Town of Ramapo, the defendant hit the victim in the head with a large rock causing a laceration as well as pain and swelling to the victim’s head. 
Upon the defendant’s arrest, he was placed into the rear of a police car.  The defendant broke the passenger side window and door of the patrol car by kicking same.  

Noe Montez-Lopez was sentenced by the Honorable Charles Apotheker on June 8, 2011 as follows:  With respect to the Assault 2nd Degree conviction, the defendant was sentenced to three (3) years in State Prison and five (5) years Post Release Supervision along with surcharges and a DNA fee.  With respect to the Criminal Mischief 4th Degree conviction, the defendant was sentenced to one (1) year in the Rockland County Jail to run concurrent to the defendant’s three (3) year prison term on the Assault 2nd Degree Conviction.
